ABC Novel Necessities - Shipping Insurance Terms and Conditions

These Shipping Insurance Terms and Conditions govern the purchase and coverage of shipping insurance offered by abc novel necessities ("we," "us," or "our") to our customers ("you" or "your") for products purchased through our website or other sales channels. By purchasing shipping insurance, you agree to these terms and conditions.

1. Scope of Coverage

  • Shipping insurance covers physical loss of or direct damage to the insured items while in transit by a third-party carrier, subject to the exclusions listed below.
  • Coverage is limited to the declared value of the items as stated in your order confirmation or the actual cash value of the items, whichever is lower, up to the maximum coverage amount selected at the time of purchase.
  • This insurance is valid only for the specific shipment for which it was purchased and ends upon delivery of the shipment to the designated address.

2. Exclusions

Shipping insurance does not cover the following:

  • Loss or damage resulting from acts of God (e.g., earthquake, flood, hurricane).
  • Loss or damage caused by inherent vice or defect in the nature of the product itself (e.g., spoilage of perishable goods).
  • Loss or damage arising from delay, confiscation, or intervention by customs or other government authorities.
  • Loss or damage due to war, terrorism, or civil unrest.
  • Indirect or consequential losses, such as loss of profits or business interruption.
  • Damage that is cosmetic in nature and does not affect the functionality or intended use of the product (e.g., minor scratches, dents, or blemishes).
  • Shipments addressed to P.O. Boxes or APO/FPO addresses, unless specifically stated otherwise.
  • Shipments that have been successfully delivered according to the carrier's tracking information.
  • Theft or loss after delivery to the designated address.

3. Purchasing Shipping Insurance

  • Shipping insurance can be purchased during the checkout process for an additional fee, as displayed on our website.
  • The option to purchase shipping insurance is voluntary and must be selected by you before completing your order.
  • The premium for shipping insurance is non-refundable once the shipment has been processed.

4. Filing a Claim

  • In the event of loss or damage, you must notify us in writing (via email to abc.novel.necessities@gmail.com) within 2 days of the delivery date (for damage) or the expected delivery date (for loss). Failure to notify us within this timeframe may invalidate your claim.
  • You must provide us with the following documentation to support your claim:
    • Your order number.
    • A detailed description of the lost or damaged items.
    • Photographic evidence of the damage to the item(s) and the packaging (if applicable). Please retain the original packaging until your claim is resolved.
    • Any communication received from the carrier regarding the loss or damage.
    • Proof of the value of the items (e.g., order confirmation, invoice).
  • We reserve the right to request additional information or documentation as needed to process your claim.
  • We will review your claim and notify you of our decision within 3 business days of receiving all required documentation.

5. Claim Settlement

  • If your claim is approved, we will, at our discretion, either:
    • Issue a refund for the declared value of the lost or damaged items (up to the maximum coverage amount).
    • Arrange for a replacement of the lost or damaged items, subject to availability.
  • The settlement amount will not exceed the original purchase price of the item(s) or the maximum coverage amount selected.
  • Shipping insurance premium will not be included in the claim settlement.
  • We reserve the right to reject any claim that does not meet the terms and conditions outlined herein or for which fraudulent activity is suspected.

6. Subrogation

  • By accepting a claim payment, you agree to subrogate to us any rights you may have against the carrier or any other party responsible for the loss or damage. You agree to cooperate fully with us in any investigation or legal action we may take.

7. Modifications to Terms

  • We reserve the right to modify these Shipping Insurance Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. The terms and conditions applicable to your purchase will be those in effect at the time you purchased the shipping insurance.   

8. Governing Law

  • These Shipping Insurance Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Alabama without regard to its conflict of law provisions.
